Please read these terms carefully before using n8nautomation.cloud

1. Acceptance of Terms

By accessing and using n8nautomation.cloud ('the Service'), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

We reserve the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.

2. Description of Service

n8nautomation.cloud provides hosted n8n workflow automation instances. The Service allows users to create, manage, and execute automated workflows connecting various applications and services.

The Service includes access to a web-based n8n instance, data storage, workflow execution, and support services as described in your selected plan.

3. Account Registration and Security

You must provide accurate and complete registration information when creating an account. You are responsible for maintaining the security of your account and password.

You are fully responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

4. User Responsibilities

You are responsible for all content and activity in your account, including workflows, data, and integrations. You agree not to use the Service for any illegal or unauthorized purpose.

You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws).

You are responsible for ensuring that your use of the Service complies with all applicable laws and third-party service terms.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.

5. Payment Terms

The Service is billed in advance on a monthly basis and is non-refundable except as specified in our refund policy. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

For any upgrade or downgrade in plan level, your credit card will be charged the new rate on your next billing cycle. Downgrading your Service may cause the loss of features or capacity of your account.

6. Cancellation and Termination

You may cancel your subscription at any time through your account dashboard. Upon cancellation, your service will continue until the end of your current billing period.

We reserve the right to suspend or terminate your account if you breach these Terms of Service or if we determine that your use of the Service is causing harm to us or other users.

Upon termination, your right to use the Service will immediately cease. We will provide you with 30 days to export your data before permanently deleting it.

We are not liable to you or to any third party for any termination of your access to the Service.

7. Data Retention and Backup

We perform regular automated backups of your data as described in your service plan. However, you are solely responsible for maintaining your own backup copies of your workflows and data.

After account termination, we will retain your data for 30 days before permanent deletion. It is your responsibility to export your data during this period.

We are not responsible for any loss of data due to account termination, service interruptions, or technical issues.

8. Service Level Agreement (SLA)

We guarantee 99.9% uptime for Starter and Pro plans, and 99.99% for Enterprise plans, calculated on a monthly basis.

Planned maintenance windows are excluded from uptime calculations. We will provide advance notice of scheduled maintenance whenever possible.

If we fail to meet the SLA, you may be eligible for service credits as described in our SLA policy. Service credits are your sole remedy for any downtime.

9. Intellectual Property

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and music (the 'Content'), and all Intellectual Property Rights related thereto, are the exclusive property of n8nautomation.cloud and its licensors.

You retain all rights to your workflows, data, and content you create or upload to the Service. By using the Service, you grant us a limited license to host, store, and backup your content as necessary to provide the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall n8nautomation.cloud, its affiliates, directors, employees, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

We are not responsible for any damages or losses resulting from your use of third-party integrations, APIs, or services accessed through n8n workflows.

11. Warranties and Disclaimers

The Service is provided 'as is' and 'as available' without any warranties of any kind, either express or implied.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk.

12. Indemnification

You agree to indemnify and hold harmless n8nautomation.cloud and its affiliates, directors, officers, employees, and agents from and against any and all claims and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs the use of personal information in the Service and to which you agree to be bound.

We collect and use information as described in our Privacy Policy. We will not sell or share your personal information or workflow data with third parties except as necessary to provide the Service or as required by law.

14. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by n8nautomation.cloud.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by use of such content, goods, or services.

15. Modifications to Service

We reserve the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which n8nautomation.cloud operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
